Terms of Use for PopcornMan

1. Provider and scope

These terms apply to the game PopcornMan. Apple’s Standard License Agreement (EULA) also applies. Where the two conflict, these terms prevail as far as Apple permits. The German version is authoritative.

2. The game

PopcornMan is free and funded by ads. There is no account; your progress lives on your device. If you delete the app or switch devices, progress, kernels and items are lost, except for the “Remove Ads” purchase (section 5).

3. Leaderboard and your content

A day’s top three are shown publicly with their display name and, if entered, social handle and profile picture. For this content:

• No insulting, sexual, violent, discriminatory or unlawful content, no advertising.
• Only enter a social handle that is yours and a picture you hold the rights to. Do not impersonate anyone.
• We check top-3 entries automatically (see the privacy policy, section 3.3) and show them only once they pass. Every entry can be reported from the leaderboard; after several reports it is hidden automatically. There is zero tolerance for objectionable content: we may hide or delete entries at any time and exclude players from the leaderboard.
• By entering them, you allow us to show your name, handle and picture on the leaderboard while they are stored. You can change or remove them at any time.

4. In-game currency and items

Kernels, chests, items, skins and gadgets are part of the game. They have no monetary value and cannot be exchanged for money, transferred or sold. We may change in-game prices, rewards and chest contents to balance the game.

5. “Remove Ads”

The one-time “Remove Ads” purchase permanently turns off the ads before a new run; video ads you choose to watch (e.g. to continue) stay available. It is not a subscription. Purchase, payment and refunds go through Apple. On a new device or after reinstalling, restore the purchase under “Profile” → “Restore purchases”; the same Apple ID must be signed in.

6. Availability and changes

The leaderboard and ads need an internet connection and our servers or those of the ad services. We aim for smooth operation but do not guarantee any particular availability. We may develop the game further and change or discontinue features; the “Remove Ads” purchase remains valid as long as the game is offered.

7. Fair play

You receive a simple, non-transferable right to use PopcornMan for private purposes. Not allowed: manipulating scores or requests to our servers, automated requests, technically circumventing ads, and modifying or redistributing the app. We delete manipulated entries.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee or fraudulently concealed a defect.

For simple negligence, we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes using the game possible in the first place and on which you may rely), limited to the typical, foreseeable damage. Otherwise liability is excluded. We are liable for other players’ content on the leaderboard only once we know it infringes the law.

9. Apple devices

• Your contract is with us, Robert Beutelspacher (TurboBarn), not Apple. Apple is not responsible for maintenance or support; help is on our help page and by email.
• If the game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price paid. Apple has no other warranty obligation.
• Claims relating to the game, such as product liability, failure to meet legal or consumer protection requirements, or alleged infringement of third-party rights, are directed to us, not Apple.
• You confirm that you are not located in a country subject to a US government embargo and are not on a US sanctions list.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Final provisions

We may change these terms with effect for the future where there is good reason, such as a change in the law or a new feature. The date at the top shows the current version.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, its mandatory consumer protection rules remain unaffected. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board. If any provision is invalid, the rest remains valid.
